Terms of Service
These terms explain the rules for using Chirpy, a community service with Discord sign-in, profiles, posts, images, messages, notifications, and polls. By accessing Chirpy, you agree to these terms. If you do not agree, do not use the service.
1. Eligibility and your account
Chirpy is intended for people who are at least 13 years old in the United States. You may not use Chirpy if you are under 13. If you are 13 or older but have not reached the age of majority where you live, you may use Chirpy only with the involvement and permission of a parent or legal guardian. You must also meet Discord’s applicable minimum-age requirements and follow Discord’s terms. You are responsible for activity under your account and for keeping access to your Discord account secure. Sign-in is provided by Discord; Chirpy does not receive or store your Discord password.
2. Community content and conduct
You are responsible for content you submit, including profile details, posts, uploaded images, comments, messages, mentions, and poll questions or options. You must have the rights and permissions needed to submit it. Do not use Chirpy to break the law, threaten or harass people, share another person’s private information without permission, impersonate others, distribute malware, infringe intellectual-property rights, or interfere with the service. Do not attempt to bypass access controls or misuse the service.
3. Your content and permission to operate Chirpy
You retain any rights you have in your content. You give Chirpy a limited, non-exclusive permission to host, store, reproduce, and display content as needed to provide and maintain the features you use, including showing posts and images to other users, storing messages and poll votes, and displaying social activity notifications. This permission ends when the content is removed from active service, subject to copies retained as described in the Privacy Policy and technical backups or records.
4. Moderation and account restrictions
Chirpy staff may review content and accounts, remove or hide posts, mute accounts, change access, or terminate accounts when reasonably needed to enforce these terms, respond to safety concerns, or protect the service. Moderation decisions may be made with or without advance notice where permitted by law. Terminated accounts lose access. A terminated account may be appealed once within 30 days; after that period it cannot be reinstated and account content is scheduled for purge, subject to minimal reservation and moderation records described in the Privacy Policy.
5. Intellectual property and reports
Chirpy’s name, logo, interface, and original service materials are owned by or licensed to the service operator and are protected by applicable law. These terms do not grant you ownership of them. If you believe content on Chirpy infringes your rights, contact the service operator using the contact information described below with enough detail to identify the content and your concern. No designated notice agent or legal contact has been configured yet.
6. Third-party services and availability
Chirpy depends on third parties, including Discord for authentication and the MongoDB service configured by the operator for application data. Those services have their own terms, privacy practices, availability, and security controls. Chirpy may be changed, interrupted, or discontinued. Features are provided as available, and the operator does not promise uninterrupted service, error-free operation, or permanent availability of content.
7. Disclaimers and liability
To the fullest extent allowed by law, Chirpy is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent allowed by law, the operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or service access, arising from use of Chirpy. Nothing in these terms limits liability that cannot legally be limited or excludes rights that cannot legally be waived.
8. Changes and governing rules
These terms may be updated as Chirpy changes or legal requirements evolve. The current version will be posted at this URL; continued use after an update takes effect means you accept the revised terms. These terms are intended to be governed by applicable United States law and, where applicable, the laws of the state in which the service operator is established, without displacing mandatory consumer protections that apply to you.
